These Terms and Conditions apply to all contracts for the supply of goods and the provision of services (switchable smart glass films and related services) between Claus Fischbach – FilmyFolie (hereinafter the “Provider”) and the customer. Any deviating terms of the customer are not recognised unless the Provider expressly agrees to their application in writing.

The presentation of products and services on this website does not constitute a legally binding offer, but an invitation to make an enquiry with no obligation. A contract is only formed once the Provider issues an express order confirmation or the customer accepts an individual quotation. Unless stated otherwise, individual quotations are valid for 14 days.
The prices stated in the relevant quotation apply. Unless otherwise agreed, invoices are payable in full, without deduction, within [X] days of the invoice date. For custom-made goods or larger orders, an advance payment may be agreed.
Delivery and completion dates are binding only where they have been expressly confirmed in writing. Where installation is agreed, the customer must provide suitable conditions on site (e.g. access, a clean substrate, a power supply). Partial deliveries are permitted where they are reasonable for the customer.
The goods supplied remain the property of the Provider until payment has been made in full.
The statutory warranty rights apply. Obvious defects must be reported without delay upon receipt of the goods or acceptance of the service. For products made to the customer’s individual specifications, returns for reasons other than a defect are excluded.
In the case of distance contracts, consumers are generally entitled to a statutory right of withdrawal. The right of withdrawal does not apply, or expires early, in the case of goods made to the customer’s specifications or clearly tailored to personal requirements (Section 312g (2) of the German Civil Code, BGB). The Provider is liable without limitation for damage arising from injury to life, body or health, and in cases of intent and gross negligence. In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical of this type of contract. Liability is otherwise excluded. Mandatory statutory provisions (in particular the German Product Liability Act) remain unaffected.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The place of jurisdiction is – to the extent permitted by law – the Provider’s registered place of business.
